RENTAL TERMS & CONDITIONS
 
RESERVATION VERIFICATION AND GUEST RANGER: The name on the reservation must match the name on the credit/debit card used for payment, the name on photo I.D., and the name/signature on this rental agreement. This person is considered the guest/renter. The guest/renter is required to complete identity and payment verification via Guest Ranger, an encrypted software used to prevent and avoid fraudulent transactions. Identity and payment verification via Guest Ranger, must be completed within 72 hours of booking. Failure to complete, or failure to pass verification via Guest Ranger may lead to a cancellation of the reservation. Rental Agent/Company Representatives will not discuss reservation details with other individuals who are not the guest/renter listed on this agreement. 
 
AGE REQUIREMENTS: Guest/Renter must be over the age of 25 to make a reservation. 
 
PAYMENT POLICY: 35% of the reservation total is charged at the time of booking and is applied to room rent only. Full payment is required 30 days before arrival. Rental Agency/Company Representatives have the right to automatically charge any credit or debit card on file for any remaining balance on, or after the due date. SPI Rentals accepts personal checks at our own discretion. There is a $50.00 fee for NSF checks. Rental Agent/Company Representative has the right to cancel reservation, without refund, if final payment is not received 30 days prior to arrival unless previous payment arrangements have been made in writing. 

SHORT TERM RESERVATION CANCELLATION POLICY: A reservation made for 29 consecutive days or fewer is considered a short term reservation. A 30 day notice is required for cancellations. Cancellations that are made 30 or more days prior to the arrival date will incur a $150.00 cancellation fee. All other paid fees, with the exception of travel insurance (if applicable), will be refunded. Reservations booked via VRBO are not subject to the $150 cancellation fee, if canceling 30 or more days in advance. Cancellations made within 29 to 14 days prior to arrival date will forfeit 50% of the room rent, plus the non refundable reservation fee, and applicable taxes. All other paid fees, with the exception of travel insurance (if applicable), will be refunded. Cancellations made less than 14 days prior to arrival date will forfeit 100% of the room rent, plus the non refundable reservation fee, and applicable taxes. All other paid fees, with the exception of travel insurance (if applicable), will be refunded. Cancellations, changes to reservations, and/or early departures do not warrant any refund of rent or deposit. Requests to change dates (reschedule reservation) may only be made 30 or more days prior to the arrival date. Thereafter, rescheduling is NOT allowed. If a reservation is made 29 days or fewer from the arrival date, the above policies will still apply. 
 
MONTHLY RESERVATION CANCELLATION POLICY: A reservation made for 30 consecutive days or more is considered a monthly reservation. A 60 day notice is required for all monthly reservation cancellations. Cancellations that are made 60 or more days prior to the arrival date will incur a $150.00 cancellation fee. All other paid fees, with the exception of travel insurance (if applicable), will be refunded. Reservations booked via VRBO are not subject to the $150 cancellation fee, if canceling 60 or more days in advance. Cancellations made within 30 to 59 days prior to arrival date will forfeit the full 35% advance payment and damage deposit (if applicable). Cancellations made 29 days or fewer from arrival will forfeit the full amount of room rent, plus the non refundable reservation fee, and applicable taxes. All other paid fees, with the exception of travel insurance (if applicable), will be refunded. Cancellations, changes to reservations, and/or early departures do not warrant any refund of rent or deposit. If a monthly reservation is shortened and no longer qualifies for the discounted monthly rate, the rate will be adjusted according to the rate schedule. Requests to change dates (reschedule reservation) may only be made 60 or more days prior to the arrival date. Thereafter, rescheduling is NOT allowed. If a reservation is made 59 days or fewer from the arrival date, the above policies will still apply. 
 
OPTIONAL TRAVEL INSURANCE: A travel and rental protection plan can be added to a reservation upon request. The following plans are offered: Standard and Cancel For Any Reason. The cost of a Standard plan equals 7.000% of the reservation grand total. The 7.000% payment is due in full at time of purchase and is non refundable after 9 days of purchasing the plan. The cost of a Cancel For Any Reason plan equals 10.800% of the reservation grand total. The 10.800% payment is due in full at time of purchase and is non refundable after 9 days of purchasing the plan. Optional travel and rental protection is provided by a third party partner, Rental Guardian. Rental Guardian is the direct contact for all trip protection claims and information. Guests must contact them directly to file a claim. 
 
HURRICANE OR STORM POLICY: No refunds will be given unless (A) The National Weather Service orders mandatory evacuation in a "Tropical Storm/Hurricane Warning area" and/or (B) A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest. The day that the National Weather Service orders a mandatory evacuation order in a "Tropical Storm/Hurricane Warning" area, we will refund: (A) Any unused portion of rent from a guest currently registered, (B) Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the Hurricane Warning is lifted; and (C) Any advance rents collected or deposited for a reservation that is scheduled to begin during the "Hurricane Warning" period. 
 
NO REFUND OR CANCELLATION FOR CERTAIN EVENTS: Unless stated otherwise in this Agreement, the obligations of the guest/renter to this Agreement will not be suspended, forgiven or canceled and any advanced funds will not be refunded, for any of the following events, including but not limited to, acts of God; epidemic, virus pandemic or contagious disease; abnormal weather conditions, to include but not be limited to, tropical storm, flood and hurricane. In the event a shelter-in-place order is announced which prevents the guest/renter from renting the property, and it falls on the rental dates of this Agreement, the guest/renter may request in writing to change the dates of their reservation to another time; however, the rate and number of nights will remain the same as the original reservation. In the event the new dates are at a higher rate than the original reservation, the guest will be responsible for paying the increased amount and there will be no refund. 
 
CHECK-IN/OUT POLICY: Check-in begins at 4:00 p.m. central time. Check out is at 10:00 a.m. central time. All keys and garage door remotes (if applicable) must be returned to the SPI Rentals office upon departure. A $50 fee will be charged for each key or garage remote that is not turned in at that time. If the property is not vacated at 10:00 a.m, the renter may be charged a late departure fee of up to 50% of the nightly rental rate. Early check-ins are rarely possible and are never guaranteed. On rare occasions and due to unforeseen circumstances, a property may not be available for check-in directly at 4:00 pm. In the event that a check-in is delayed, the guest/renter may be offered a late check-out or prorated rate for the night. 
 
MAXIMUM OCCUPANCY: Each rental property has a maximum occupancy that includes infants and children. The maximum occupancy includes the entire property, i.e. driveways, yards, pool areas, decks, and entire interior of home. Day guests or visitors are NOT permitted at any time. If extra guests above the maximum occupancy are found on the property, the entire group may be asked to vacate the property. Any security deposits and all rent will be subject to forfeiture. During the month of March and Semana Santa/Holy Week security wristbands are issued to all registered guests. If a guest loses a security wristband, a replacement fee of up to $150 will be charged to the guest. Wristbands may NOT be interchanged by guests. Absolutely no house parties are permitted. Any persons on the property above the maximum occupancy stated, are in violation of this agreement.
 
VEHICLE MAXIMUM: Each rental property has a maximum vehicle occupancy. Parking on the grass or street is NOT permitted. Rental properties may have designated parking areas or assigned parking spaces which require parking permits. Parking permits are provided by SPI Rentals or the HOA/Property Manager. The guest/renter is responsible for ensuring their permit is displayed appropriately and their vehicle(s) are in the designated parking space. Strict compliance with parking rules is enforced at all times. SPI Rentals, LLC and company affiliates, the HOA and the Property Manager reserve the right to have vehicles towed at the guest’s expense. SPI Rentals, LLC is not responsible for towed vehicles due to parking rule violations. 
 
PET AND ANIMAL POLICY:  The guest acknowledges that no pets and/or animals are allowed in or on the premises unless the Agent has expressly authorized such use. Some of our properties allow pets and/or animals, while others do not. The non-refundable pet fee is required per pet. This fee does not cover damage, breakage, or extra cleaning caused by the pet. Additional cleaning fees may also apply, for dog waste not cleaned prior to check out. Prior permission must be granted for pets and/or animals. Specific rules must be followed. Unauthorized occupancy of pets and/or animals will result in a $250 fine, immediate eviction, and loss of all rents and security payments. 
 
DAMAGE WAIVER: (applicable in all months except March and during Semana Santa/Holy Week on select properties): The damage waiver is a mandatory non refundable fee for all rental guests. The waiver will cover any accidental damage up to $1,500.00. The SPI Rentals accidental damage waiver has certain conditions. The waiver will not include liability for damage or theft resulting from: 
 
• Intentional acts of a guest 
• Any damage that occurs if guests are in violation of the lease agreement 
• Gross negligence or willful and wanton conduct. 
• Any cause, if the Covered Guest does not report the damage to SPI Rentals staff.
• Does not cover theft of personal property or property belonging to vacation rental.
• Damages caused by any pet or other animal brought onto the premises. 
• The waiver applies only to the direct physical loss or damage to covered property. It does not cover loss of use of such property. 
• Coverage does not apply for theft or damage of any property owned by or brought onto the premises by a covered guest. 
• Loss, theft or damage caused by any person other than guest/renter or traveling companions with whom the guest/renter shares the Accommodation reservation unless substantiated by a police report. 
 
SECURITY DEPOSITS: (applicable during the month of March and Semana Santa/Holy Week on select properties): The security deposit is not applied toward rent; however, it is fully refundable within 30 days after departure, provided the following provisions are met:
 
• No damage is done to the accommodation or its contents. 
• No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay. 
• All trash is discarded in the proper receptacle. 
• All keys are left at the property or given to the rental manager. All charges accrued during the stay are paid prior to departure. 
• No linens/furniture are lost or damaged in the home/condominium. 
• No early check-in or late check-out. 
• The renter is not evicted by the owner (or representative of the owner), Rental Agency, the local law enforcement, or the security company. 
• Subject to and not limited to fines from Association and / or Rental Agency. 
 
EXCESS DAMAGE TO PROPERTY: Rental Agent/Company Representatives reserve the right to charge the guest’s method of payment on file in the event property damages exceed specified damage deposit amount or in the event cost of damages exceeds the $1,500.00 coverage provided by the damage waiver. 
 
HOMEOWNER'S ASSOCIATION PENALTIES AND FINES: Rental Agent/Company Representatives reserve the right to charge the guest’s method of payment on file in the event the Homeowners Association (HOA) fines the homeowner/management company due to rental guest's actions/behavior while occupying the property. By signing this rental agreement, the guest/renter agrees to pay the fines that result from violations of the HOA rules and regulations in the event they occur. 
 
PROPERTIES FOR SALE BY OWNER and UNAVAILABILITY: Rental properties may also be on the market for sale by the property owner. In the event this rental property is sold and is no longer managed by SPI Rentals, LLC, an alternative property at equal value, determined by Rental Agent/Company Representative, may be offered for the same dates and at the same cost of the original property. If the guest/renter does not agree to a new property, or if an alternative property is not available, the reservation will be canceled and a full refund will be provided. On rare occasions, the rental property may no longer be available due to emergency maintenance or unforeseen circumstances. In the event the property is no longer available for the guest's dates, an alternative property at equal value, determined by Rental Agent/Company Representative, may be offered for the same dates and at the same cost of the original property. If the guest does not agree to a new property, or if an alternative property is not available, the reservation will be canceled and a full refund will be provided. 
 
PRIVATELY OWNED PROPERTIES: Each rental property is individually and privately owned. SPI Rentals has described all rental properties and their furnishings as accurately as possible based on the owners’ information and provision. Occasionally, owners will remodel or redecorate, add or remove an item, or discontinue a service. SPI Rentals will make reasonable efforts to communicate changes with the guest, however, it is not guaranteed. Additionally, within each property garages, closets, or cabinets may be locked or inaccessible. These areas are for the property owner’s use only and off limits to guests. The guest/renter acknowledges that they are renting the property “as-is.” No additional furnishings or equipment will be provided. No refunds will be given for changes made to the rental property, or for the inability to access/use locked owner’s areas. Breaking into locked areas, or attempting to break into locked areas will result in a fine of $500. 
 
PROPERTY CONDITION, REPAIRS AND REFUNDS: SPI Rentals makes every effort to ensure that all rental properties are fully functioning. Guests are required to report any maintenance issues encountered during their stay to SPI Rentals immediately. SPI Rentals will make every effort to address the issues as quickly as possible, however, it is not guaranteed. General wear and tear should be expected in rental properties, especially older houses or condominiums. No refunds or rate adjustments will be made for mechanical failures, appliances failures, general wear and tear, discontinued or interrupted services that occur during a guest’s stay. 
 
POOL, HOT TUB, AND SAUNA AREAS (IF APPLICABLE): Guests may use the Pool, Hot Tub and Sauna at their “OWN RISK” (if applicable). The owner of the property (the "owner"), Landlord, and Rental Agency are not liable for any injury or death. When a cold front comes through and temperatures drop below 55 degrees the pool and/or hot tub heaters shut off to prevent malfunction. This temperature does not include wind chill. Properties with both a heated pool and hot tub will only allow for one to be heated at a time. Hot tubs typically run on a timer of 3 hours +/-, therefore, guests may have to reset the timer often to ensure the heat stays on. Hot tubs may not be heated upon arrival and may take a few hours to heat to desired temperature. Heated pools may take 24 hours or more to reach desired temperature after the hot tub is used. In the summer and hotter months, pools may naturally become warm due to the sun's heat. Refunds will NOT be given for any of the above conditions. 
 
COMMUNITY AMENITIES: SPI Rentals does not maintain community amenities or other common areas including but not limited to swimming pools, hot tubs, gyms, parking facilities, or elevators. Occasionally, these amenities may be unavailable or out of service. SPI Rentals will make reasonable efforts to communicate changes with the guest, however, it is not guaranteed. No refunds or rate adjustments will be made for unavailable community amenities. 
 
SERVICE OUTAGES: Guests may encounter outages for services including, but not limited to internet, cable, water and/or electricity. These services are provided by a third party and outages are beyond SPI Rentals’ control. No refunds or rate adjustments will be made for interrupted services that occur during a guest’s stay. 
 
BEACHES AND BEACH ACCESSES: South Padre Island beaches are public. Reserving a property with a private beach access does not entail private use of the beach located near the rental property. Occasionally, areas of the beach may be unaccessible or undergoing re-nourishment (dredging), and/or public beach accesses may be closed. SPI Rentals/Company Representatives are not responsible for communicating beach or beach access conditions with guests. No refunds or rate adjustments will be made for the inability to access areas of the beach or beach accesses, or for unfavorable beach conditions. 
 
SELF-CATERING PROPERTIES (ESSENTIALS): Vacation rental properties are self-catering accommodations. SPI Rentals provides a complimentary starter kit of essentials which generally includes a limited amount of toilet paper, paper towels, trash bags, soap, shampoo/conditioner, dish soap, laundry detergent, coffee & filters, olive oil, and salt & pepper. Once these items are used, it is the guest’s responsibility to replenish them for their own use. Additionally, the following items are not universally provided or guaranteed to be in the rental property: condiments and spices, cleaning wipes or cleaning products, bottled water, hair dryer, ice & cooler, beach towels, beach chairs, toys, floats, sun lotion/sunblock, extra blankets and pillows, pack-n-play, high chair, stroller, baby gates, and/or first aid kit. 
 
WILDLIFE AND INSECTS: Each rental property is serviced by a professional pest control company chosen by the homeowner or Homeowners Association and on a regular basis. These preventative efforts do not guarantee guests will not encounter insects or pests during their stay. SPI Rentals is not responsible for the intrusion of insects or pests of any kind, within or outside of the rental property. No refunds or rate adjustments will be made. 
 
INCLUSIVE FEES: Rates include a one time linen and towel setup. We do not offer towel exchange. Amenity fees are included in the rental rate. 
 
MAID SERVICE: While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring beach towels, as they are not provided and we do not permit towels or linens to be taken from the units. If the guest would like maid service, the rental agency can arrange accordingly.
 
PERSONAL ITEMS: SPI Rentals, LLC and company affiliates are NOT responsible for any personal items left on property after check out. It is the guest’s/renter’s responsibility to ensure their belongings are removed from the property upon departure. Any items found at the property after departure may be discarded without notice. 
 
RIGHT TO ENTER: SPI Rentals, LLC and company affiliates reserve the right to enter the rental property listed in this agreement at any time for any reason. 
 
EVICTIONS: The guest/renter and all other occupants may be evicted for failure to comply with the rules and regulations of the rental agency, condominium complex, or HOA. In the event that the Police Department is contacted and is dispatched to the rental property for noise complaints, obnoxious or offensive behavior, etc., the guest/renter may receive one verbal warning from SPI Rentals, LLC or company affiliates. If the issues persist, the guest/renter and all other occupants will be evicted immediately. In the event of an eviction, the guest will forfeit all funds paid to the rental company. 
 
RATE CHANGES: Rates are subject to change if the guest's stay is shortened, or dates of stay are modified. 
 
FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.

SMS TERMS AND CONDITIONS

SMS CONSENT COMMUNICATION: The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

TYPES OF SMS COMMUNICATION: If you have consented to receive text messages from SPI RENTALS, you may receive messages related to the following: Example: "Hello, this is a friendly reminder of your upcoming reservation with SPI Rentals at [Location] on [Date] at [Time]. Reply STOP to opt out of SMS messaging at any time."

MESSAGE FREQUENCY: Message frequency may vary depending on the type of communication. For example, you may receive up to [10] SMS messages per week related to your reservation or inquiry.

POTENTIAL FEES FOR SMS MESSAGING: Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.
